OBJECT AND SCOPE


1.1 These General Terms and Conditions of Sale exclusively regulate the purchase and sale made on Efforie's online store, between the “Customer” as buyer and Efforie as seller, and apply to all visitors to the www.efforie.com website, as well as to any commercial transaction made through this online store.

1.2 Browsing the website and purchasing any product from www.efforie.com implies acceptance of these general terms and conditions of use and contracting.

1.3 “Customer” or “User” or “Buyer” shall mean any person acting on/buying products from the Efforie online store.

1.4. Efforie reserves the right to change these conditions of use and contract without prior notice, as well as to modify the information and commercial offer presented on products, prices, promotions, commercial conditions and services at any time, and any changes will always be published on the website www.efforie.com.

1.5. Efforie reserves the right not to process any order received from users who do not agree with the general terms and conditions of sale of the “Seller” (Efforie).

1.6. The “Customer” must provide Efforie, as the buyer, with a correct and complete e-mail or postal address or other contact details and agrees that Efforie may contact him/her using these details if it deems it appropriate.

 

INFORMATION ON THE CONTENTS OF THE EFFORIE ONLINE STORE


2.1. The website www.efforie.com is intended for private use only, so the reproduction, transfer, distribution or storage of the contents of the Efforie online store, without prior written authorization, is prohibited for any purpose other than strictly personal use.

2.2 The introduction of links to our website for commercial purposes or without prior authorization from Efforie is expressly prohibited, as is the use of the www.efforie.pt domain for abusive purposes without prior authorization, which may be subject to recourse to the competent legal means by Efforie.

2.3 In the event that you find links on other websites giving you access to www.efforie.com or references to the Efforie online store, we inform you that Efforie has no responsibility for these links or pages, nor for the content contained therein.

2.4 Efforie is strongly committed to ensuring that the information presented on www.efforie.com is free of spelling errors and whenever these occur, we will correct them as soon as possible.

2.5 All contractual information is written in Portuguese, as is the information on the items, email communications and formalization of the sale, with the exception of expressions very specific to the world of luxury products.



COMMERCIAL POLICY


3.1 In the event that the information presented does not correspond to the characteristics of the product, the Customer has the right to terminate the purchase and sale contract under the applicable legal terms.

3.2 Prices and product characteristics are subject to change without prior notice.

3.3 Validation of the purchase order assumes that the “Buyer” is aware of and accepts the General Terms and Conditions of Sale of the www.efforie.com website.

3.4 All the data recorded by Efforie constitutes proof of all the transactions carried out between Efforie and the “Customer”, and Efforie is responsible for archiving the electronic document formalizing the contract and undertakes to keep it accessible.

OBLIGATIONS OF CUSTOMERS AND USERS


4.1 Any visitor to the www.efforie.com website undertakes to comply with and respect these general conditions, in particular by observing the following obligations:

4.1.1. it is forbidden to introduce, store or disseminate through the Efforie website defamatory, obscene, insulting, xenophobic and/or any other type of content that violates the general principles of law and public order;

4.1.2. keep, and not disclose, your password for entering the website in order to prevent third parties from accessing your account and personal data;

4.1.3. not using false identities;

4.1.4. provide correct personal data and addresses so that Efforie can process orders properly;

4.2. The “Customer” is solely responsible for the veracity of the personal data communicated to Efforie and undertakes to enter and immediately inform any changes via their Registration Account at www.efforie.com.

4.3 Efforie disclaims any liability for any delay or impossibility of processing the order due to error or insufficiency of the data communicated by the “Customer”.



PLACING AN ORDER ONLINE


5.1 In order to place an order at www.efforie.pt, the “User” must have a valid and frequently used e-mail account. It is not compulsory to register as a customer in order to make purchases, but we advise you to do so in order to keep your purchase history in our store and to be able to access all the necessary information. To make a purchase, simply insert all the products you wish to buy into the virtual shopping cart and follow all the steps to successfully complete the purchase. You can also register during the purchase process and will be asked to do so if applicable.

5.2 As soon as you complete your purchase, you will receive an automatic e-mail confirming the transaction with a summary of your order. We suggest that you download this copy for future reference. This summary will also be available on your account page. If the data is not correct, you should immediately ask for it to be changed, or even for the purchase to be canceled.

5.3 In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, Efforie reserves the right not to accept your order, or to cancel it in whole or in part, even after it has been automatically confirmed.


PRODUCT AVAILABILITY AND ORDER CONFIRMATION/CANCELLATION 

6.1 Efforie will only process an order placed by a customer once payment has been confirmed, and therefore cannot guarantee the availability of the items until such time as they have been processed.

6.2 During the process of placing the order, you will be informed of the estimated date of dispatch of the products. The estimated shipping time may vary depending on the destination of your order.

6.3 Efforie only dispatches orders on working days. Therefore, weekends and public holidays are not taken into account when estimating delivery times. Any delay in the dispatch of items, compared to the estimated dates shown, does not entitle you to compensation.

6.4 Fulfillment of all orders placed on the website is subject to product availability. Efforie reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In the event of product unavailability and/or out of stock, Efforie will immediately inform the “Customer” of the partial or total cancellation of their order, and the buyer is entitled to a refund of the applicable amount or credit of that amount for purchases on the website, whichever is preferred.



ORDER CONFIRMATION OR CANCELLATION


7.1 Orders submitted to www.efforie.com for delivery by post or courier will only be considered confirmed and processed once they have been properly collected.

7.2 If the products ordered on www.efforie.com are no longer available when you last access the site, despite having obtained confirmation of the order, or when Efforie receives your order, Efforie will immediately inform the “User” of their unavailability.

7.3 If an order has been placed, and payment made, for products that have since become unavailable, Efforie will refund or credit the money paid for the unavailable items.

7.4 Efforie reserves the right to refuse any order for any reason and is not liable for any damages or costs, and reserves the right to cancel any purchase even if it has already been accepted or confirmed by Efforie, namely in the following situations: The information on the invoice is not correct or verifiable; The order is flagged by the website's Security Systems as an incorrect, irregular order, or an order susceptible to fraud; When payment for the order is not received within 2 working days of submitting your order; When it is not possible to deliver the order to the address provided by the “User”; If it considers that the “Buyer” did not have the capacity to carry out that act. If it is found that there has been an error in the presentation of the price of the product(s).

PAYMENT TERMS AND SECURITY GUARANTEES


8.1. The payment methods available will be shown at www.efforie.com. We do not accept any other payment method than those mentioned.

8.2 In the case of postal orders, products can be paid for using a credit or debit card, Paypal, Apple Pay or Google Pay, and the Efforie website provides the necessary instructions for these payment methods.

8.3 When paying by credit card, all details (such as card number, expiry date or security code) will be sent by encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by Efforie, except to carry out the necessary operations for purchase or reversal (refund), in the event of a return in accordance with the exercise of the right of return, or for reporting cases of fraud to the police authorities.

8.4 The total amount indicated on the order form comprises the purchase price of the products (including VAT if applicable) and the applicable transportation/shipping costs.

8.5 We urge you not to attempt to make payment by any means other than those specified at www.efforie.com. If you do, Efforie cannot be held responsible for the loss of the monetary value paid, or any other damages that may result.

8.6 Our Efforie product reservation policy requires an initial payment of 30% of the total value of the reserved product. This amount guarantees the reservation of the item for a period of 30 days, during which the customer has the opportunity to make the remaining payment. If the 30-day period is exceeded without payment having been completed, Efforie reserves the right to cancel the reservation, and the customer will not be reimbursed for the amount of the reservation.
By accepting the booking policy, the customer is agreeing to the store's terms and conditions.
This policy aims to guarantee transparency and fair availability of products for our customers.

SECURITY OF THE ONLINE STORE AND ALL TRANSACTIONS


9.1 The Efforie online store uses the latest and most robust security technologies available for data encryption. All the information you provide will be encrypted from the initial moment of your transaction until the order is processed and will not be stored on any public server.

9.2 Although we use highly advanced encryption software, any payment transmitted over the Internet or via e-mail runs certain risks, particularly when the “User” does not take the necessary precautions and does not assume the necessary responsibility.

9.3 Efforie cannot be held responsible for any damage suffered as a result of the use of electronic means of communication, in particular damage resulting from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or computer programs used for communications or transmission of viruses.



RESERVATION OF OWNERSHIP OF MARKETED PRODUCTS


10.1 Efforie retains ownership of all the products on the website until it has received full payment for the order.

PRICES


11.1. The total price specified at the end of the purchase process includes taxes and shipping/delivery costs. Prices are quoted in your order confirmation, which you can print or download for future reference. The “Customer” must pay only the exact amount specified in the order confirmation.

11.1. Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country and location where your order will be delivered and, eventually, the total purchase value.

11.2. Prices are all broken down in Euros and any change in the country and location of delivery of the order may have an influence on prices, due to transport costs.



QUALITY AND GUARANTEE


12.1. Efforie will only sell quality items on www.efforie.com that can prove their authenticity.

12.2. The products available on www.efforie.com may not exactly correspond to the final product in terms of colors, especially due to the internet browser and monitor used.

12.3  All items sold by EFFORIE are subjected to rigorous evaluation processes to ensure their condition, stability, integrity and absence of defects. After the stipulated return period has ended, EFFORIE is not responsible for any wear or damage resulting from normal use of the products. By making a purchase from EFFORIE, the customer declares that he/she agrees to all the terms and conditions established here.


EXCHANGES AND RETURNS

13.1. REFUND FOR CANCELLATION

If the customer is not satisfied with the products supplied, they may return them within 14 calendar days of receipt. As a rule, the seller makes the refund within 10 working days and, in any case, within 30 days from the date of confirmation via email of the right to a refund. The right to return only occurs if the products:

Have not been washed or used;

Maintain the original characteristics and the packaging is not damaged;

Are complete (e.g. both items in a pair must be returned);

They have not been tampered with and retain the identification label.

Return shipping costs are the responsibility of the customer and must be sent by registered mail.



13.2. RETURN OF OFFERS

The return of an offered product must be made by the person who offered/purchased it. In this case, to proceed with the return you must contact the person who purchased it, so that they can proceed with the return, in accordance with the return conditions, due to defect or non-conformity or due to withdrawal.

If the defect or non-conformity is confirmed as reasons for the return, the entire amount paid will be refunded.

The refund of the amount paid will always be made using the same payment method used for the purchase. If the customer wishes, they can receive a voucher to use in the store, valid for 90 days.

Return shipping costs are the responsibility of the customer and must be sent by registered mail.



13.3. EXCHANGE FOR OTHER ITEMS

To exchange one item for another, please follow the steps below:

An item can only be exchanged for another of equal or greater value. In case of exchanging an item for a different one, any campaign/promotion received in the original purchase will not be maintained in the exchange, unless otherwise indicated in the respective promotional campaign.

Your products can only be exchanged once. If you are not satisfied after requesting an exchange, you can only return your order. 

If the customer wishes, they can receive a voucher to use in the store, valid for 90 days.



HOW TO PROCEED:

1ST STEP

Send an email to info@efforie.com. The body of the email must contain the following information:

– Order number;

– Reason why you want to exchange or return the product.

– Tell us the items you want to return/exchange;

– If you are returning and have paid by entity and reference, inform us your IBAN, so that we can make the refund.

2. STEP 1: PLACE ITEM IN BOX

You can use the original packaging where you received the order;

Send or deliver the product: Wait for feedback from us with instructions for returning the product(s).


Return shipping costs are the responsibility of the customer and must be sent by registered mail.



SHIPPING OF PRODUCTS AND DELIVERIES


14.1. Products ordered from the Efforie online store will be shipped and delivered on business days, Monday to Friday.

14.2. We can only guarantee the correct delivery of an order if the shipping address of the products is correctly indicated by the “User”.

14.3. A delivery is considered made or a product is considered delivered with the signing of the delivery receipt at the agreed address.



SHIPPING COSTS


15.1. Shipping costs associated with your order will be billed per order, meaning if you order more than one item, you will only pay shipping costs once.

15.2. Shipping costs to mainland Portugal will cost 5.99 Euros per order.

15.7. The “Buyer” must inspect the packaging and products received to check for any damage. If you find that the products are damaged, you must contact Efforie within 24 hours via email (info@efforie.com).

 

RETURN OR CANCELLATION WITH FLOA PAYMENTS

If the item was purchased using FLOA, in the event of return or cancellation, 5% of the purchase value will be deducted for credit interest and administrative costs of the platform, which are not refunded even after the cancellation or return of the purchase. Therefore, by selecting FLOA as the payment method, the customer is accepting the cancellation and return policy.





ORDERS DELIVERY TIMES


16.1. After registering your order, payment being confirmed and all items in your order being available, Efforie undertakes to prepare the order within 1 to 2 working days, and to proceed with shipping in mainland Portugal, which should be done in an average of 1 to 2 business days.

16.2. Any delay in the dispatch of items, in relation to the estimated dates presented, does not entitle the customer to any right to compensation.



RESPONSIBILITY


17.1. Efforie will only be responsible for damages suffered by the “Buyer” in the event that such damages result from breaches attributable to Efforie's contractual obligations to the “Consumer”, or in the event that liability arises of applicable legal law.

17.2. Efforie cannot be held responsible for damages suffered by the “Buyer” as a result of improper use of our products.

17.3. Efforie is not responsible for damages resulting from incorrect information on the website or on the product itself.

17.4. All products sold by Efforie comply with Portuguese and Community legislation.

17.5. Efforie declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the Customer to check with local authorities the import or use conditions of the products they wish to order.



CHANGES TO TERMS AND CONDITIONS


18.1. Efforie has the right to change these Terms and Conditions at any time. The “Buyer” is subject to the principles and terms in force on the date of their order, unless the law or competent authority imposes any change to them.
